Marulam J. Hutauruk has years depth experience in many litigation matters especially in Criminal, Commercial and Administrative Litigation representing high profile and majors companies, inside and/or outside Indonesia as well. He provides you with solutions based on law, ethics and his experiences. He will assist you to reach well-thought-out decisions in court battle. He is a member of Indonesian Bar Association (PERADI) since 2000 and built his reputation as a lawyer who works to the highest professional standards. He speaks Indonesian and English.

He has represented the following:

  • Diebold Incorporated and PT Diebold Indonesia, an International company that provides self-service and security system. He succeeded in defending against suits by its ex-distribution agent;
  • BP Indonesia Ltd. an Oil and Gas Company, in defending against suits by its bidder in the Tender of Management and Logistic Service Procurement worth US$ 74 million in the Indonesian State Administrative Court;
  • BP Indonesia Ltd., in hearing of the Business Competition Commission regarding allegations of conspiracy in Procurement Tender of Integrated Shore Base Management and Logistic Services for the Tangguh Drilling Project in Papua;
  • ConocoPhillips in relation to tort claim brought by Randy Rizaldi as a Receiver (Kurator) of PT Saptasarana Personaprima (in bankrupt);
  • Asian Wall Street Journal in a successful defamation litigation which reached settlement agreement in 2005;
  • Time Inc. in defamation allegations brought by Abu Bakar Baashir, an Indonesian Moslem Cleric.
  • Samtan Co Ltd and Samchully Pharmaceutical Ltd. on a high profile mandatory divestment of share of one big coal mine, PT Kideco Jaya Agung, to Indonesians investors;
  • Total E&P Indonesia, in bankruptcy litigation brought by its contractors and subcontractors;
  • Matra Magazine, in a successful defence on defamation allegation brought by Hercules Rozario, 2004;
  • Association of Indonesian Television (Assosiasi Televisi Seluruh Indonesia/ATVSI) in Judicial Review of Indonesian Law of Broadcast to Constitutional Court;
  • Barnabas Suebu, the 2006 elected governor of Papua, Indonesia, in petition that was filed by prospective Governor who had lost be election for Governor of Papua Province;
  • PT APCO Worldwide in a successful defence against defamation and unlawful act (tort) suit brought by the Governor and Provincial Government of East Kalimantan, 2004.
  • Giving legal advice to the Directors of PT International Nickel Indonesia Tbk. In connection with allegations of immigration violations;

His Pro bono Activities:

  • Giving legal advice and accompany Pilots of Adam Air during an interrogation by Police of the Republic of Indonesia. The Professional Pilot had been reported to the Police for his efforts to save a commercial airliner that should have been flown to Makassar but had gotten lost and landed on Tambouloka Nusa Tenggara, due to malfunctioning navigational instruments.;
  • PT Tempo Inti Media, in a defamation claim against the Press brought by Tommy Winata.

Intellectual Property Consultant

He is an Intellectual Property Consultant who worked at The Sound Recording Industry of Indonesia (ASIRI) as General Manager since 1 July 2009-May 2012. His mutual networking has been developed with many significant association (especially IP Consultant Association), Indonesian Government etc, Professors/Experts. Moreover, cooperation and collaboration with other societies such as International Federation Phonogram Industries (IFPI) in Asia, London and Digital Copyright Asia Network in Korea, China, Japan and Indonesia has enhanced his networking in IP issues.

He understand Intellectual Property Law especially Copyright Law (Music) very well, therefore Indonesia Police Department asks him at least once in a month as a tutor to train Junior Police Investigator.

The Police Investigator and the Court ask him to give Expert Statement in Investigation Process, Prosecution Process and the Court Process as well.

He involves and actives to give comments on the Draft of New Indonesian Copyright Law (2009, 2010, 2011 and 2012).
